Stoned driver crashed through gardens

A stoned Stirling driver smashed into fencing and ploughed through gardens when he lost control of a car in Raploch.

Donald Muir, of Charter Street, pleaded guilty to driving while unfit through drink or drugs in Drip Road on August 10.

The 39-year-old also admitted driving carelessly and possessing cannabis resin.

Stirling Sheriff Court heard on Wednesday that shortly after 10pm Muir had been driving on Drip Road when the vehicle veered across the opposite carriagewa­y and knocked over 5ft high railings before entering the garden at 4 Drip Road.

The car then continued through a wooden fence and into the garden of 6 Drip Road.

The fiscal depute said the occupant of number 4 heard the collision and went outside to find the accused inside the vehicle in the neighbour’s garden.

Muir then got out of the vehicle. The occupant of number 6 also came out of the house.

Both residents spoke to Muir and formed the opinion he was impaired in some way but were unable to smell any alcohol from him.

The fiscal depute said: “He was unsteady on his feet, his eyes were glazed and his speech slurred.”

A breath test proved negative but Muir was taken to a police office. He told officers he did not think he was impaired, but a doctor confirmed impairment following an examinatio­n.

The fiscal depute said that throughout the procedure Muir had been described as flopping about and falling asleep.

Muir told officers he had been driving along Drip Road and felt the car’s wheel jerking. He also said he had put his foot on the brake but added: “I maybe didn’t hit it hard enough”.

Police found Muir had a bag containing cannabis weighing 0.8g.
