Teen warned over bail breach

- Court reporter

A Stirling teenager breached bail by turning up at her former boyfriend’s house in Fallin at the weekend.

Amber Fleming, of Cowane Street, had admitted a charge of breaching a bail condition imposed on April 10 this year.

The nineteen-year-old had failed to comply with the condition without reasonable excuse by entering Balure Crescent on Sunday, April 15.

At Stirling Sheriff Court on Monday, Fleming’s agent Ken Dalling told Sheriff William Gilchrist his client had attended at Dylan Ballard’s address that day “without objection.”

However, police went to speak to Ballard and found Ms Fleming there when she should not have been at the house.

There was no offending behaviour towards Miss Fleming from her former partner, Mr Dalling pointed out, but “conflict”arose with other people, not the householder.

The lawyer explained:“In the context of that conflict she wanted to get somewhere safe.”

Mr Dalling said Fleming did not have much of an offending history.

However, Sheriff Gilchrist pointed to another matter which called at the court last week, to which he heard the circumstances.

He referred to Fleming alleging that her former partner, Dylan Ballard, had attempted to throw her downstairs and drag her downstairs.

Given that, he added, the Balure Crescent address was“hardly a safe place.”

Mr Dalling however insisted that in relative terms it had been.

Sheriff Gilchrist noted that Fleming was due back at Stirling Sheriff Court on May 2.

He deferred sentence on the matter until that date and told Fleming she was not to go to Balure Crescent in Fallin. He added:“If you do it again you will be remanded in custody. Don’t go there.”
