Vicious attack followed sex romp

A woman’s boyfriend was assaulted in a Deanston street amid a row about her mother being caught in bed with a man half her age.

Megan Gardner had returned to her home in Teith Road early on April 9 last year to find her mother Sabrina having sex with 20-year-old accused Craig Roxburgh.

Her mum, who is in her early 40s, and Roxburgh had earlier been at a party at the house upstairs.

Fiscal depute Wainwright Craig told Stirling Sheriff Court yesterday (Thursday) Sabrina Gardner and Roxburgh were caught at 4.30am when Megan and her boyfriend Kyle Russell returned after a night out. “A heated exchange then took place between all four parties,” he added.

Sabrina Gardner then kicked her daughter and boyfriend out of the house and they went to collect Megan’s grandparen­ts, her mother’s mum and dad.

Roxburgh, who had been at the party with his brother Stephen, got dressed and went back upstairs.

Mr Craig said the party had been coming to an end and people were leaving when Megan Gardner and Kyle Russell got back to Teith Road.

A large amount of people were out in the street having left the party.

As Roxburgh left he happened upon Megan Gardner and Kyle Russell, Mr Craig pointed out.

As the couple tried to get into Megan Gardner’s car, Roxburgh pulled Kyle Russell to the ground, repeatedly punched him to the head while he lay there and repeatedly kicked him to the body.

Mr Craig added: “Persons at the party eventually pulled the two males apart and police were contacted.”

When officers arrived Roxburgh was no longer there, but was later detained. Mr Russell had sustained swelling to his right ear and bruising to his left temple.

Roxburgh’s agent Virgil Crawford told Sheriff Derek Reekie that Megan Gardner had not been happy about her mother’s consensual ‘casual liaison’ with his client.

He also pointed out that Roxburgh had been under the influence of alcohol that night.

The lawyer said Roxburgh, now 22, of Burnbank, Port of Menteith, is in full-time employment in Doune as a spray painter, and earns £1200 per month.

Roxburgh had admitted a charge of assaulting Mr Russell to his injury.

His brother 20-year-old Stephen Roxburgh, of Teith Road, Deanston, and a third accused Louis Stewart (20), of Trossachs Road, Aberfoyle, had also originally been accused of assaulting Mr Russell. However, their not guilty pleas to this charge were accepted by the Crown.

Sheriff Reekie told Roxburgh that it had been fortunate that Mr Russell had not sustained more serious injuries. However, taking account of his age and lack of any previous conviction­s, he was prepared to impose a financial penalty totalling £850.

He fined Roxburgh £600 and ordered that he pay Mr Russell £250 in compensati­on. The total was payable at a rate of £75 per month.
