Man, 42, kicked his partner

In court for order review

A Fallin man pulled his partner to the floor and kicked her, Stirling Sheriff Court was told.

Paul Morgan assaulted Elizabeth Kerr or Proc to her injury at his home in Murray Court on February 27 this year. The 42-yearold also punched a wall kicked furniture, shouted and swore, and made threats of violence.

He admitted two charges of behaving in a threatenin­g and abusive manner and a charge of assault to injury when he appeared at court the following day.

The assault and one of the threatenin­g behaviour charges had been aggravated by abuse of a partner or ex-partner.

Morgan had previously been sentenced to 18 months’ supervisio­n and told to attend alcohol counsellin­g.

At the court on Wednesday, Morgan’s agent Harry Couchlin explained that a review of the order showed “a measure of progress.”

The solicitor added: “He is engaging with the order, but there have perhaps been slip-ups.” Mr Couchlin said Morgan had had alcohol problems for a number of years. And he had been admitted to hospital earlier this month after taking a cocktail of drugs.

Morgan was now living in Denny, Mr Couchlin said, to take him away from drink and with “a view to amending his lifestyle.”

Sheriff William Gilchrist told Morgan the “initial progress” he had made under the order imposed in May had been undermined by the drugtaking incident earlier this month.

He told Morgan: “There is no point getting away to Denny to end up inviting [others] there and taking drugs which involved you going to hospital.”

Sheriff Gibson set a further CPO review for March 6. He was ordered to appear on that date.
