A man who told cops called out to a disturbanc­e in Cambusbarr­on that it would take three officers to ‘lift him’ was this week fined £450.

Derek McKinlay had admitted a charge of behaving in a threatenin­g and abusive manner at his Gillies Hill address on October 29 last year.

The charge had originally further stated that the 45-year-old had also behaved aggressive­ly to his partner Sharon Cunningham by seizing her by the head and body, repeatedly spitting on her head and throwing a mobile phone and items of furniture. However, McKinlay pleaded guilty to an amended charge from which these aspects had been deleted as well as mention of an aggravatio­n involving a partner or ex-partner.

The fiscal depute told Stirling Sheriff Court on Monday that officers attended the Gillies Hill address at 12.30am in relation to an ongoing incident.

When officers arrived they told McKinlay that he was under arrest. He told officers: ‘If you are lifting me it will take all three of you.’

He made no reply when cautioned and charged. McKinlay’s lawyer Virgil Crawford told Sheriff Wyllie Robertson that it did not take all three officers to arrest McKinlay who was then taken to a police station.

He was later released on a police bail undertakin­g, Mr Crawford pointed out, and had no other matters outstandin­g.

McKinlay earned around £1500 per month, Mr Crawford added, and was in a position to pay a fine.

Sheriff Robertson fined him £450 reduced from £500 due to the timing of the guilty plea, avoiding a trial.

The sum was payable at a rate of £100 per month.
