Fallin man fined for shouting abuse at wife

- COURT REPORTER

A Fallin man who verbally abused his partner was this week fined £300.

Albert Leiper had admitted a charge of behaving in a threatening and abusive manner – aggravated by abuse of a partner or ex-partner – at an address in Main Street on June 21 last year.

Fiscal depute Lindsey Brooks told Stirling Sheriif Court on Wednesday that the parties had been married for 13 weeks and had lived together for 18 months at the time of the incident.

That evening the 61-year-old accused had been out drinking at a local bar and his wife was at home. She had gone to bed when the accused returned about 11pm. He knocked on the door and and the witness let him inside.

However, he began to shout and swear and called his wife abusive names, said Ms Brooks.

She tried to calm him down, but he continued to shout and swear and became aggressive towards her.

The court heard she walked away and went upstairs. However, Leiper continued to verbally abuse her. After 35 minutes the witness decided to call the police.

A neighbour nearby had also heard Leiper but had not contacted the police, said Ms Brooks.

Leiper’s agent Lisa McGuigan told Sheriff Di Emidio that her client had been drinking and only had a vague memory of events.

She added: “He advises me today that he has [cut down] his alcohol consumption.”

She also said the couple were trying to reconcile, adding: “They are meeting up regularly and hoping to put the matter behind them.”

Leiper’s had one road traffic offence on his record, she said, and he was “in receipt of state benefits and can make payments towards a fine.”

Sheriff Di Emidio told Leiper, who is currently living in homeless accommodation, that a fine was appropriate as it was “a fairly prolonged incident” affecting his spouse who had contacted the police, and it had been overheard by other people.

The £300 fine was payable at a rate of £10 per week.
