£80K COMPO CLAIM OVER CHOPPER TRAGEDY

Last month, Evelyn Mitchell was refused permission to represent David at the planned Fatal Accident Inquiry.

Now the 59-year- old has launched a separate action for damages over his death, even though she last saw her half-brother in 1991.

Ten people died when his pol ice hel icopter crashed into the roof of the Clutha Vaults pub in Glasgow on November 29, 2013.

Evelyn claims she was in regular contact with David through social media and phone calls for two years unti l the tragedy, though they never met up.

Her damages case is due to be heard at Glasgow Sheriff Court on February 23.

She is claiming “loss of society” over David’s death – a legal right that allows people to claim compensati­on over the loss of a relationsh­ip with a relative.

Evelyn was adopted in 1960. She was put up for adoption when she was six months old by mum Agnes, who gave birth to David two years later.

“When I heard about the crash that night, I knew David was dead. I sent him text messages in the hope he was still alive.

“This is not about money but getting justice for David. It’s vital to me that David is cleared of blame.

“That’s one of the reasons I wanted to be heard at the FAI and why I’m taking the action for compensati­on.

“The possibilit­y of a pilot of his experience making a mistake is highly unlikely.”

Reiki therapist Evelyn attended David’s funeral at Glasgow University and a wreath-laying ceremony led by Princess Anne at the Scottish Police Col lege in September 2014.
