OF course not. The Consumer Rights Act says the retailer retains responsibi­lity until the point that it was handed over to you. As the damage occurred before this point, the retailer is liable and must now give you a replacemen­t or refund.

IF it is true that she has had enjoyment from the flowers then they have a point. If she did not, they have breached the contract for delivery on February 14. In which case you would be entitled to a full refund.

I PAID a £200 deposit for a used car. The dealership later told me they had sold it to someone else in error. They said my deposit is non-refundable and they will transfer it to another car of my choosing. Can they do this? Tracey Roberts

NO. You paid them the deposit for a specific car. They cannot sell you it so they must pay your deposit back.
