Kildonan Hotel fined after breaking minimum wage law

Harbour Havens Limited, trading as Kildonan Hotel, is among 191 companies named by Her Majesty’s Revenue and Customs (HMRC) for breaking national minimum wage laws.

The breaches all took place between 2011 and 2018 and while not all of them were intentiona­l, it remains the responsibi­lity of companies to ensure that they pay their employees according to the national minimum wage laws.

Kildonan Hotel was listed in the national minimum wage naming scheme bulletin for failing to pay a total of £2,478.12 to four workers between June 2014 and August 2017.

The naming scheme exists to increase awareness of national minimum wage legislatio­n and to act as a deterrent to the minority of employers who may be tempted to underpay their workers.

Following a 2018 review of the naming scheme to ascertain its effectiven­ess and to ensure that naming was used in the most efficient way, the scheme has been continued since 2011 and it regularly publishes the names of businesses that break national minimum wage laws.

Business minister Paul Scully said: ‘Our minimum wage laws are there to ensure a fair day’s work gets a fair day’s pay. It is unacceptab­le for any company to come up short.

‘All employers, including those on this list, need to pay workers properly. ‘This government will continue to protect workers’ rights vigilantly and employers that short-change workers won’t get off lightly.’

The latest bulletin – round 17 – calculates that the cumulative totals of all of the underpayme­nts amounted to £2.1 million owed to 34,000 workers. Named employers have since been made to pay back what they owed and collective­ly were fined an additional £3.2 million.
