Sex act perv spared prison
MAN ‘TOUCHED HIMSELF’ IN CAR NEAR SCHOOL
A PERVERT who watched porn and performed a sex act in a car just yards from a packed children’s playground has avoided jail.
Kadir Kadir was caught in broad daylight with his shorts down and “touching himself inappropriately” while sat in his vehicle, which was parked up just four metres from Hotspur Primary School, in Heaton, Newcastle.
The court heard around 60 children, aged four and five, were in the school playground at the time.
The married 33-year-old was interrupted by a passer-by, who shouted “Oh my God” and immediately reported what she had seen to the police.
Kadir, who was working for Dominos Pizza at the time but was not on shift, drove off but was traced by officers because of his distinguishable yellow car.
The dad-of-two was arrested and said in interview: “I have stress. I made m ********* n and the lady saw me”. He claimed he had found a “quiet spot” to watch porn on his phone and his chosen location had nothing to do with the children playing nearby.
As previously reported, Kadir, from of Clive Place, Byker, pleaded guilty to one count of outraging public decency last month.
Magistrates adjourned his sentence for the preparation of a pre-sentence report and warned the Bulgarian he faced a possible stint behind bars.
But, at a hearing at North Tyneside Magistrates’ Court on Thursday, Kadir was given a 24-month community order and was fined £50. He was also ordered to pay costs and to undertake 50 days of a Rehabilitation Activity Requirement.
Lee Poppett, prosecuting, said the offence happened outside Hotspur Primary School, on South View West, in Heaton, on February 6.
He said: “The witness says, as she walked along the street, it was 9.30am and a number of children were playing in the playground. Indeed, the headteacher confirms there was about 60 children in the playground that day.
“It’s at this point, the witness noticed a yellow motor vehicle.
“The motor vehicle was parked about four metres from the perimeter of the playground. The witness said the driver’s side was closest to the curb so, therefore, closest to the playground.” Mr Poppett then read an extract of the witness statement to the court.
He said: “The statement says: “I noticed a male and he was staring into the school grounds where the children were. As, I became level with the car, I looked down. “I could see a male who had his trousers pulled down”.”
The court heard the witness described seeing Kadir performing a sex act and him then apologising when he saw her before driving off.
Neil Connell, defending, said Kadir has since lost his job with Dominos.
He said: “He was aware there was a school in the vicinity but he did not choose that area because of that school.
“He chose it because it was quiet there – the presence of the school was coincidental. There’s no evidence to suggest that any child saw what he was doing.”
Mr Connell said Kadir, whose wife was in court supporting him, was remorseful, embarrassed and ashamed.
