Court Reporter A TEENAGE girl was sexually assaulted by an abuser who “accidentally” recorded the attack while using his mobile phone torch to see what he was doing.

Alex Evans, 17 at the time, molested the 16-yearold when she fell asleep or unconscious after drinking cheap cider.

The girl started to stir during the attack, and in the footage can be heard telling Evans “no, no, no,” a court heard.

Evans, now 20, said he had inadvertently recorded images and video of the sexual assault on his phone while using the torch on it, which prosecutors accept.

Now he has been locked up for the offences, which happened in a secluded outdoor area in Washington. Judge Amanda Rippon, at Newcastle Crown Court, told Evans: “You took out your phone and used it as a torch in order, no doubt, to see better to assault her. “As you did that, clear footage of what you were doing, assaulting her, was recorded on your phone.” The judge added: “She was telling you ‘no’ on a number of occasions. Her voice is Judge Amanda Rippon slurred. She barely, in fact, moves at all. Her body is moved by you.”

Evans, of Helmond, Sulgrave, Washington, admitted sexual assault and making an indecent photograph of a child.

He was jailed for three years and eight months and must sign the sex offenders register for life.

Julie Clemiston, defending, said Evans feels real remorse over the attack, which he carried out when he was 17 and had also been drinking.

In the time since the offences, Evans has become a father, found work and has “grown up a very great deal”.

Miss Clemitson told the court Evans now realises the impact his behaviour has had on other people.

She added: “He is facing, fairly and squarely, his actions as a reckless, feckless, youth.”

Evans has no previous convictions for sexual offences, the court heard.
