Man jailed for £3,000 window smashing at Montrose pub

A man who caused £3,000 worth of damage after throwing rocks through the window of a pub he was thrown out of has been jailed for three months.

Kevin Paton’s sentence will be soaked up in a 44-month prison term he is currently serving, avoiding the prospect of the 39-year-old not being released from behind bars until 2020.

Paton, previously of Emislaw Drive in Arbroath, appeared before Sheriff Jillian Martin-Brown at Forfar to be sentenced in respect of the offence at the Lochside Bar on North Esk Street, Montrose, in August last year.

Depute fiscal Robbie Brown said Paton’s behaviour had been such that he was asked to leave the premises, but he claimed his bank card had been lost.

“That was located and he returned and was seen to pick up three rocks and simply threw them through two four foot by three foot windows,” added the fiscal.

“I understand that glass for commercial premises is somewhat more expensive than might be anticipate­d.”

Defence solicitor Billy Rennie said: “His liberation date is currently scheduled for June next year and then he would be subject to any further licence conditions.

“There clearly would not be any repayment potential for this sum for some significan­t time.”

The agent said that if Paton received a consecutiv­e sentence which took him over a certain threshold the impact would be a release date of around 2020, a six-month sentence effectivel­y adding 18 months to his current term.

“The matters he received 44 months for were largely from last year and if this had been with them it would likely have been part of that sentence.”
