Two men admit ‘particular­ly unpleasant’ Hogmanay attack

Two men who carried out a Hogmanay assault outside a takeaway in Arbroath were yesterday each ordered to pay their victim £350 compensati­on.

James Swankie, 22, of Union Street East, and Kieran Murray, 23, of Weavers Close, both Arbroath, admitted repeatedly punching the man on the head and body at Millgate on December 31 2016.

Swankie also admitted committing the offence while he was on bail.

Forfar Sheriff Court heard the victim had been drinking in Carnoustie before returning to Arbroath at 10.30pm.

He made his way to a takeaway and started to have a conversati­on with two women.

Swankie threatened the man then punched him on the head and body.

Depute fiscal Bill Kermode said Murray joined in and the attack continued while the man was on the ground.

Two police officers patrolling nearby were stopped by members of the public and asked to go to the aid of the victim. He had a cut above his left eye and a swollen mouth.

An ambulance was called and the man was taken to hospital, where his cut was closed with skin glue.

Defence agent Billy Rennie, representi­ng both accused, said: “Thankfully there were no significan­t lasting injuries.

“A considerab­le amount of alcohol had been consumed.

“Both accused were in the company of the two female witnesses at the time.

“Mr Swankie took issue with the complainer going over to speak to the female witnesses when they had been in his company.

“Both admit their behaviour was particular­ly unpleasant.”
