Man admits drink-driving after smashing parents’ window

An Angus man who entered his parents’ home uninvited, smashed a window in their home and then drove while over the legal drink-drive limit is to return to court for sentencing.

Brian Wiley, 49, of St James Road, Forfar, appeared before Sheriff Derek Reekie at Forfar Sheriff Court yesterday.

At previous appearances on October 15 and 29 he pled not guilty to a number of charges but changed his plea at the third calling.

He admitted damaging property at his parents’ home in Kingsmuir on September 1 by throwing a plant pot at a window and striking another window with an unknown instrument, causing the window to break. He then struck the windows with his hands or other instruments and entered the house uninvited placing his 80-year-old mother in a state of fear or alarm.

He also admitted, on the same date, driving in Lour Road with the proportion of alcohol on his breath being 56 microgrammes, more than twice the legal limit of 22.

Defence agent Billy Rennie told the court his client had mental health issues.

He had adhered to a curfew imposed on him at an earlier appearance which banned him from leaving his home from 7pm to 7am.

He had also adhered to a ban from entering Kingsmuir or visiting his parents’ home.

Sheriff Reekie deferred sentence until December 5 for the preparation of a criminal justice social work report and a restriction of liberty assessment.

He banned Wiley from driving until then and continued his bail conditions, warning him to leave his parents “in peace until this is resolved.”
