Man broke lockdown to attend party

A 36-year-old man was locked up overnight after breaking Covid-19 lockdown rules to travel 15 miles to a raucous house party.

Ian Carmichael was found breaking bail conditions at the party which was creating so much noise that neighbours phoned the police.

Depute fiscal Lisa Marshall told Dundee Sheriff Court: “He had a bail condition not to approach Catherine Mackinnon. There was a report of a disturbanc­e at her address.

“There appeared to be a party ongoing and the accused was traced along with her. He made no reply to caution and charge.”

Carmichael, who ignored lockdown to travel from Coupar Angus to the party in Perth, had only been freed on bail a fortnight earlier.

Carmichael, of Crofton Place, Coupar Angus, admitted breaching bail by being in the home of his partner Catherine Mackinnon in Florence Place, Perth, on Wednesday.

Solicitor David Holmes, defending, said: “He has been with this lady for a short time. Unfortunat­ely, what’s taken place is that she wishes to continue with the relationsh­ip.

“Mr Carmichael had been staying with his mother in Coupar Angus. His partner had come there and left something and he went to give her it back.

“He had been in her company. It’s fair to say he feels a degree of protective­ness towards the complainer because she was the victim of an assault a week ago.

“She is older than he is and a vulnerable individual and is finding it difficult without him.

“There was a small party going on.

“He had the requiremen­t that he didn’t attend the property, and the neighbours have seen him there and reported him.

“He has tried to move away from his previous associatio­ns. He appreciate­s that the court’s patience is not inexhausti­ble.”

Sheriff John Rafferty said: “Do you understand the precarious situation you are in? The only things I can do are imprison you or get a report.

“You are very close to a custodial sentence here. Even if your partner invites you you cannot go round.”

He deferred sentence on Carmichael for reports and granted him bail.
