Ex-sheriff wins battle in divorce saga
A disgraced former sheriff who experienced “despair, distrust and desolation” when his marriage ended has won a bid to have a legal decision which granted divorce overturned.
Raj Jandoo, 58, instructed lawyers to go to the Court of Session in Edinburgh after a sheriff gave authority to his former partner Nerinder Kaur’s bid to formally end their relationship.
Ms Kaur had gone to Dunfermline Sheriff Court in February 2016 and used the “simplified” divorce procedure to end their marriage.
However, Mr Jandoo had previously told Ms Kaur’s lawyers that he was in dispute with her over their finances and that the use of this legal procedure was inappropriate.
The former advocate said he knew nothing of Ms Kaur’s legal action at Dunfermline Sheriff Court. He said if he had known, he would have instructed lawyers to stop the action.
Mr Jandoo instructed lawyers to go to Scotland’s highest civil court and they asked judge Lord Woolman to set aside the Dunfermline Sheriff Court decree at earlier proceedings.
Yesterday, in a written judgment issued at the Court of Session, Lord Woolman ruled in favour of Dr Jandoo.
He wrote: “Despair, distrust and desolation. These words are often associated with divorce. The pursuer experienced all these emotions following the breakdown of his marriage.”
