Assault accused had allegedly told victim that she ‘deserved it’

Man denies five charges linked to domestic abuse of two women

A man accused of assaulting two former partners can allegedly be heard on a video posted online telling one of them she “deserved it”.

David Kinloch, 34, is accused of repeated attacks on the women at addresses in Fife.

In footage shown in Kirkcaldy Sheriff Court, a female, said to be one of the alleged victims, could be heard telling a person she called David “you had me by the throat” and saying he had punched and kicked her on the face.

A voice replied “you deserved it” for “f***ing about”, before the female said “you could’ve killed me last night”.

Giving evidence, PC Robert Salmond told a jury he believed the voice on the video, in which only the woman can be seen, was Kinloch’s.

He told how he had attended a flat in Lochgelly shortly before midnight on May 6 in relation to social media footage and concerns for the welfare of the woman.

Kinloch is accused of assaulting her at 140 Lumphinnan­s Road, Lochgelly, on May 5.

It is alleged he put his hand over her nose and mouth and seized her by the throat, restrictin­g her breathing, punched her on the head with a set of keys or similar in his hand and threatened to kill her.

He is also accused of behaving in a threatenin­g or abusive manner towards her on the same date and assaulting her on various occasions between May 2015 and March 2018 at addresses in Dunfermlin­e and Anstruther.

Kinloch also faces charges of assaulting a second woman on various occasions between March 2002 and January 2005 at an address in Barrie Street, Methil.

He is alleged to have chased her with a knife and seized her by the throat and to have conducted himself in a disorderly manner and threatened her with violence repeatedly between December 2003 and January 2005.

He denies the five charges against him.

Mr Salmond said Kinloch and the first alleged victim were both intoxicate­d when he arrived and they denied posting footage on social media or that an assault had occurred. The couple continued to drink while officers were there for more than hour, he said.

An ambulance was called for the woman before Kinloch was arrested on suspicion of assault, the court heard.

Mr Salmond said she had taken “some kind of seizure, an epileptic fit, similar to that” and that Kinloch had held her as it continued, apparently to protect her.

The trial continues.
