Pair face sentencing over assault

Two Perth men who kicked a smoker outside a pub will be sentenced at court on February 14.

Kenneth Chalk, 34, of Glenearn Road, and Del Banks, 29, of Speygate, both Perth, admitted assaulting the man on July 15 last year in County Place by kicking him on the body and repeatedly punching him on the head.

Chalk pled guilty to a further charge that on July 18 last year at an address in Pringle Court, Perth, he assaulted another man by throwing a candle at him and repeatedly punching him on the head.

Yesterday, depute fiscal Michael Sweeney told the court the victim in the first case was standing outside the Robert Burns lounge bar in Perth smoking a cigarette and handing out leaflets to passers-by at around 11.30pm.

“Chalk approached the man and kicked him on the body and punched him to the head,” he said.

“Banks then approached the man and punched him once to the face, causing the man to fall to the ground. Both accused then ran off.

“The complainer had a cut and swelling to his nose and his upper lip was swollen,” Mr Sweeney added.

“The incident was captured on CCTV and the accused were later traced.”

The court heard the other assault took place at 6.40am.

Sentence was deferred on both accused for background reports.
