Man awaits sentencing for attack

A man was left with a broken eye socket after he was attacked on a night out with friends.

James Sinclair beat Alan Witherow after the pair got into an altercatio­n at a friend’s house.

Perth Sheriff Court heard Mr Witherow had to be taken to hospital by ambulance following the incident.

Depute fiscal Charmain Gilmartin told the court: “The complainer is 33 years old and is not known to the accused.

“In the morning he had been in the company of friends and they had been drinking alcohol.

“The accused went with friends to the house – the complainer and the accused have friends in common.

“The accused and the complainer began to argue but that was diffused at that time.

“Shortly after midnight the accused and complainer began arguing again. The complainer punched the accused, who retaliated.”

The court heard Mr Witherow needed treatment at Perth Royal Infirmary.

Sinclair, of Cluny Terrace, Perth, admitted assaulting Mr Witherow at a property in Perth’s South Street on October 18 2016 by repeatedly punching him in the head, striking him with his knee, kicking him in the head and striking him on the head with a glass bottle, all to his severe injury.

Sheriff Gillian Wade deferred sentence for reports.

She said she was remanding Sinclair in custody due to the seriousnes­s of the attack.
