European Court role
SIR – Lord Neuberger is being disingenuous (“Top judge calls for clarity on future role of European law,” August 9).
English courts have always been receptive to the judgments of other courts, in particular those applying English law, in determining questions before them. There is no reason why they should not take account of those of a European court where European law is involved. These decisions may be of assistance but will not be binding.
That will be the position in relation to the judgments of the European Court of Justice, when it has ceased to have jurisdiction here.
