There is no evidence to support the Trust’s explanation that Mr Boberek was imminently dying. His hydration had been inadequate and there is no evidence he was encouraged to drink fluids, which would have been safest in light of his CHF [chronic heart failure]. There is no evidence that his CKD [chronic kidney failure] or CHF had deteriorated to terminal levels… [The Trust should] acknowledge… Mr Boberek would have survived this illness.
