Man failed to give sample of breath

A 31-YEAR-OLD man has pleaded guilty to driving without insurance and refusing to give a sample of breath.

Lazar Visinel Caldaras, of Flat 2-2, 180 Prospect Hill Road, Toryglen, Glasgow, appeared in Oban Sheriff Court on Monday August 28, where his sentence was deferred for criminal justice social work reports. The incident took pace in the early hours of August 27.

His vehicle was spotted braking randomly and veering over the double white lines on the A85 Oban to Dunbeg road.

The police were phoned and they saw the vehicle near Taynuilt travelling at a low speed and crossing double white lines.

He was given six opportunit­ies to blow into the breathalys­er, but failed to register two successful samples.

One sample read 62mcg of alcohol in 100ml of breath, when 22 is the legal limit, but Caldaras failed to give the required second specimen of breath for analysis.

It was also revealed that Caldaras wasn’t insured for the vehicle. His solicitor, Jane McLaren, said that ‘he presumed he would be insured to drive the vehicle’ as it was his boss’s car.

Sheriff Patrick Hughes said: ‘For someone to drive on local roads, which are challengin­g at the best of times, late at night, drunk and without insurance, is an act of despicable selfishnes­s.’

Caldaras’s sentence was deferred until October 9.
