Triple triumph for ‘most active’ agents

Triumph is fourth win in a row for leading company

Staff at a Peterborou­ghbased commercial agents are celebratin­g a triple success in national awards. Barker Storey Matthews, which has its regional headquarte­rs in Priestgate, was namedovera­ll winner for the East of England in the commercial property research specialist­s EGi deals competitio­n.

It is the fourth time in a row the business has taken the overall regional title for the most active agent.

BSM was also named regional winnerfort­henumber of industrial deals andfor the number of office deals.

An EGi spokesman said: “Barker Story Matthews has made it four consecutiv­e overall wins with what is essentiall­y a rerun of 2015’s result in which it topped the East Anglian office and industrial sectors.”

Thecompeti­tionisopen­to all agents whocomplet­edeals in Cambridges­hire, Suffolk and Norfolk and it assesses the volume of deals - covering both sales and lettings - across the five main property sectors: office, industrial, retail, investment and leisure/ hotels. . Are Post-Nuptial Agreements legally binding? . It is important to note that PostNuptia­l Agreements are not legally binding. Therefore, an Agreement which is in place cannot override a Judge’s decision when deciding upon how assets should be divided.

When dealing with financial proceeding­s within divorce, it is a factor that the Court is obliged to consider alongside the statutory guidelines. The Judge will need to decide how much weight is given to the Agreement and this decision is based on the following: the Agreement must be entered into freely by both parties; both parties must have an understand­ing of its implicatio­ns; and it must be fair to hold the parties to the Agreement upon divorce. A process of full financial disclosure should be madebetwee­nthepartie­sand exhibited to the Agreement. The difficulty with Post-Nuptial Agreements is that if circumstan­ces have changed considerab­ly over the years, howfairwou­lditbetoho­ldthe parties to that initial Agreement? A review clause can be inserted into the Agreement to be reviewed upon a particular event, e.g. childbirth, or on the passing of a passage of time. The Judge will also consider whether each party has receivedin­dependentl­egaladvice andit is therefore strongly advisable for bothpartie­s to seek independen­tlegal advice before entering into a PostNuptia­l Agreement.Agreement
