Gay man wins fight against deportation
A man who has repeatedly claimed that he is gay has won a legal battle to avoid being deported back to his home in Pakistan.
The man, who has not been identified, instructed lawyers to go to the Court of Session so he can remain living in Scotland.
He went to the country’s highest civil court because specialist immigration judges had repeatedly ruled he had no right to remain in the UK.
The judges ruled that the man had not done enough to prove that he was a gay man who faced persecution in Pakistan due to his sexuality.
They ruled that documents which the man produced, which included a police arrest report, could have been forgeries.
Yesterday, civil appeal judges ruled that their colleagues had interpreted the law incorrectly.
