Politicians appeal over Brexit ruling
A group of Scottish politicians who are concerned by the government’s Brexit policy have launched an appeal against a judge’ s refusal to refer their case to Europe’s highest court.
The elected representat iv es–who come from the Green Party, Labour and the SNP – believe Lord Boyd was wrong to refuse them permission to take their case to the European Court of Justice.
The representatives objected to Prime Minister Theresa May’s so called “deal or no deal” approach to leaving the European Union.
They believe it is lawful for British Parliamentarians to instruct the government to withdraw its article 50 notification.
They believe Mrs May’s policy to limit Parliament to voting to either accept any negotiated EU deal or adopting a so called “hard” Brexit is unlawful.
However, the government believes that its position is lawful. Last month judge Lord Boyd ruled in favour of the government after proceedings at the Court of Session in Edinburgh.
Now the politicians– Green MSPS Andy Wightman and Ross Greer, Labour MEPS David Martin and Catherine Stihler and SNP MEP Alyn Smith – have launched an appeal at Scotland’ s highest civil court.
