Scottish Brewer loses Elvis battle
Brewdog has lost a legal battle with the estate of Elvis Presley over the name of one of its beers.
Lawyers for the singer insisted the brewery, based in Ellon, Ab erdeenshire, ch ange the name of its Elvis Juice grapefruit IPA, which it launched in 2015.
The brewery was granted the right to register Brewdog Elvis Juice as a trademark in the UK two years ago.
However, exclusive rights to the name in Europe were still sought.
The Presley estate said a bid to use the name in Europe clashed with the registered trademark and that it could be taken that the beer had been endorsed.
The European Union Intellectual Property Office has found in favour of the estate.
It said: “It is clear that the applicant’s submission based on the peaceful co-existence of the marks cannot succeed.
“No evidence actually demonstrating such peaceful existence on the pertinent market has been shown.”
The brewery was ordered to pay £1,068 in costs.
