Scottish Brewer loses Elvis battle

Brewdog has lost a legal battle with the estate of Elvis Presley over the name of one of its beers.

Lawyers for the singer insisted the brewery, based in Ellon, Ab erdeenshir­e, ch ange the name of its Elvis Juice grapefruit IPA, which it launched in 2015.

The brewery was granted the right to register Brewdog Elvis Juice as a trademark in the UK two years ago.

However, exclusive rights to the name in Europe were still sought.

The Presley estate said a bid to use the name in Europe clashed with the registered trademark and that it could be taken that the beer had been endorsed.

The European Union Intellectu­al Property Office has found in favour of the estate.

It said: “It is clear that the applicant’s submission based on the peaceful co-existence of the marks cannot succeed.

“No evidence actually demonstrat­ing such peaceful existence on the pertinent market has been shown.”

The brewery was ordered to pay £1,068 in costs.
