‘NUISANCE’ BROTHERS TRIED TO ‘SUNBATHE’ ON 50FT HIGH ROOF

TWO brothers have been told to ‘grow up’ after climbing onto a Chinese takeaway roof – to ‘sunbathe’

Ryan Linyard and Nathan Tainton were among a group of four ‘youths’ who scrambled onto the 50ft-high roof after causing a nuisance in Newcastle.

Their actions saw all three emergency services called to the scene in George Street and the closure of the road.

Magistrate­s at North Staffordsh­ire Justice Centre heard police were initially called to nearby flats.

Prosecutor Sara Beddow said: “At 2.15pm local residents called police to say there were four youths in the street. They appeared to be under the influence of drugs or alcohol and were causing a nuisance.

“They were shouting and swearing and told one member of the public to ‘f*** off’. Loud music was being played.

“Police attended. Four males were seen to go through an underpass and were then seen on the roof behind a Chinese takeaway. It is described as 50ft up.

“The ambulance and fire brigade also attended. Two males got down from the roof and were arrested, but these two defendants remained on the roof for a further half-an-hour.”

Groundwork­er Linyard and 18-yearold Tainton, both of Holly Road, Newcastle, eventually came down and were arrested. They each pleaded guilty to a charge of using threatenin­g, abusive or insulting words or behaviour likely to cause harassment, alarm or distress.

The court heard they both had previous conviction­s and the offence put unemployed Tainton in breach of a conditiona­l discharge for aggravated vehicle taking.

Khalid Waheed, mitigating, said the brothers claimed to have climbed onto the roof because they were being chased by three young men.

Mr Waheed said: “One of them thought of the idea of climbing on the roof to get away from them.

“It was a nice afternoon, they decided to stay up there for a while and sunbathe. Then, before they know it, the fire brigade and police were there. They are apologetic.”

Chairwoman of the bench Susan Sutton told them: “The time you have wasted for the emergency services – don’t you think they have better things to do? You both need to grow up.”

Tainton was fined £120 while 26-year-old Linyard – who was fined more because he is working – must pay £253. Both men must also pay £60 court costs and a £34 victim surcharge each. Tainton’s conditiona­l discharge will continue to run.

The court heard one of the other people involved in the incident had already been dealt with, while no action was taken against the other.
