BROTHERS ARMED WITH HAMMER AND METAL POLE IN ‘ALTERCATION’
Incident part of long-running feud with another sibling
TWO brothers armed themselves with weapons during an altercation with another brother.
Jason Goodwin, aged 28, drove his van with 35-year-old Daniel Goodwin in the passenger seat near to their brother Matthew’s house on May 14, 2018.
During an ‘altercation’, Jason got out of the van with a hammer and Daniel had a metal pole.
Now both men have been sentenced to a 12 month community order with 100 hours of unpaid work at Stoke-on-trent Crown Court.
Prosecutor Philip Beardwell said: “Both were seen with weapons. They were a hammer and a metal bar.”
They both pleaded guilty to possession of an offensive weapon.
Oliver Lycett, mitigating for Daniel, of Waverton Road, Bentilee, said: “He accepts he had the pole. He is remorseful. He accepts he should have left the scene rather than brandishing the metal pole.
“There has been a significant passage of time. The offence is nearly three-years-old. Nothing has happened since.”
Anis Ali, mitigating for Jason, of Rochford Way, Bentilee, said the hammer was a work tool that was in the van.
He added the defendant is in work and uses his vehicle to work.
Recorder Julian Taylor said: “There is a long running feud with your brother.
“What appears to be accepted by everyone is you both got out of the van, you Jason Goodwin with a hammer you had in your van as part of your work duties, and Daniel Goodwin, you somehow obtained a metal pole, which could have been a paint roller.
“There has been a considerable delay in this case, not of your making. I hope you can put this family feud behind you.
“It is not in anybody’s interest for this to continue.”
Both defendants were ordered to pay £50 costs.
