Jail for biting ear of security guard

- Court reporter

A drunk thug who bit part of the ear off a security guard at M&D’s after he was denied entry to the amusement area has been jailed.

Gary McMahon bit off a four centimetre piece of Stephen Docherty’s ear on the night of October 16, 2015 and appeared at Hamilton Sheriff Court last week for sentencing.

At a previous hearing, the court heard Mr Docherty was working as a security guard at the amusement park.

At 9.15pm McMahon and a friend were in the amusement area.

McMahon was going between the amusement area and the beer garden and security personnel observed him becoming increasingly drunk.

At about 10.50pm security staff made the decision not to admit McMahon to the amusement area. McMahon began to complain and tried to barge past the door staff.

He was told by the staff he was not getting in and some of the accused’s friends warned him not to continue trying.

McMahon approached the door and he and security staff got involved in a huddle.

At this point McMahon bit Mr Docherty on the left ear before leaving in a taxi.

McMahon, 26, had admitted assaulting Mr Docherty to his severe injury.

His not guilty plea to a charge of behaving in a threatening and abusive manner was accepted by the Crown.

In court last week, McMahon’s solicitor made a case that his client would be suitable for unpaid work.

However, Sheriff Douglas Brown disagreed as McMahon had been on early release from prison at the time the offence was committed.

Sheriff Brown jailed McMahon for 21 months on the offence.
