Police: Biker’s license was suspended
Fundraiser planned for family of pedestrians killed after being struck by speeding motorcyclist on Route 9
The motorcyclist who drove into a group of pedestrians, killing two on Sunday afternoon, was driving with a suspended license, State Police said.
As first reported by CBS 6 News, State Police spokesman William Duffy said Anthony J. Futia, 33, of Albany had several suspensions on his license when he crashed into and killed Quinton Delgadillo, 8,and James Persons, 38, at the head of the Warren County Bikeway on Route 9. The boy’s mother, Jasmine Luellen, 30, was injured.
A state Department of Motor Vehicles spokesman said he has multiple suspensions on his record, including one in 2019 when he was charged with driving while impaired. He had no valid license to drive a car or motorcycle.
Duffy said a toxicology report on Futia is still pending. Police did say that Futia was speeding when his motorcycle careened off the road onto the bike path. Futia is in critical condition in Albany Medical Center, and charges have yet to be determined, Duffy said.
Futia also served time in state prison. The Department of Corrections website shows he was convicted of attempted assault and sentenced to 1½ to 3 years in the Downstate Correctional Facility in 2012. He remained under community supervision through March 2018.
Friends of the deceased, like Danna Ellsworth, who owns Lake George Expedition Park, near the crash scene, are trying to come to terms with the tragedy. She is hosting a fundraiser for the family from 2 to 7 p.m. June 22, at Dino Roar Valley and Magic Forest in Lake George. Proceeds from admission, a silent auction and food sales, will go to help Luellen and her family recover.
“We can’t imagine the depth of sorrow and devastation the family is going through, yet we can imagine the expenses of dealing with the deaths of their loved ones,” Ellsworth said. “Our Lake George neighbors need us now more than ever and this is the way we can all help them.”
