A southeast Arkansas judge on Tuesday granted a new sentencing hearing for a convicted drug dealer after concluding that his attorney made “major mistakes” during the sentencing phase of the man’s April 2006 trial. Judge R. Bynum Gibson Jr., ruling in Drew County Circuit Court, granted a rare Rule 37 petition for Leon Harden, 23, who was sentenced to 80 years in prison for the crime of possession of more than 400 grams of cocaine with intent to distribute. Tenth Judicial District Prosecuting Attorney Thomas Deen said Harden will get a new sentencing hearing. A new jury will decide whether he deserves a sentence of 40 years, 80 years or life in prison.
