Mom sues Cap Metro in daughter’s death

A mother is suing Capital Metro and the city of Austin after a bus hit and killed her daughter last month, court records show.

Bethany Jai Clark, 20, was crossing West Howard Lane at Metric Boulevard at 8:45 p.m. Sept. 14 when she was struck and killed by a Cap Metro bus trying to make a turn, Austin police have said.

She died at the scene from her injuries.

The bus driver, Ronnie Calvert, 56, was cited for failure to yield the right of way to a pedestrian in a crosswalk, police said.

There was no one on the bus other than Calvert when Clark was hit.

The lawsuit accuses the bus driver of not taking reasonable care while making a righthand turn.

The suit also accuses the city of failing to keep the roadway safe by providing adequate lighting at the crosswalk.

Clark’s mother, Barbara Di Miceli, is seeking more than $250,000 in damages. Her attorney, Broadus Spivey, didn’t respond to requests for comment Friday.

A joint investigat­ion by Austin police, Cap Metro and McDonald Transit — the contractor that handles training, hiring and management of Cap Metro bus drivers — is underway, Cap Metro officials said.

In the meantime, Calvert is on administra­tive leave, said Francine Pares, Cap Metro spokeswoma­n.

Cap Metro officials could not comment further because they haven’t yet received the lawsuit, Pares said.
