Man hurt in police shootout ID'd

A man who was wounded Monday in a shootout with Austin police has been identified as 24-year-old Kyle Thomas Garcia, court documents show.

Garcia was booked into the Travis County Jail the same day on charges of aggravated assault with a deadly weapon and aggravated assault against a public servant.

An arrest affidavit filed Tuesday says police were called to a home in the 6200 block of La Naranja Lane, near Davis Lane and Escarpment Boulevard, around 12:30 a.m. after receiving reports from a woman who said her son was threatenin­g his father with a gun.

The woman told police her husband barricaded himself in their bedroom, and 911 dispatcher­s heard yelling and apparent gunshots over the phone, the affidavit says.

Police found the woman standing in the driveway, moved her to safety and took up positions around the house, the affidavit says. Her husband came out a short time later and was unharmed.

Officers saw Garcia inside the house approachin­g the front door and ordered him to disarm; instead, Garcia opened the door still holding a pistol and fired at officers, the affidavit says.

Police shot back, and Garcia moved back into the house, the document says. He emerged moments later and surrendere­d, police said.

Garcia’s father told investigat­ors that his son fired shots through the door that would have hit him if he hadn’t positioned himself away from the door, the affidavit says.

According to the affidavit, Garcia told police he was drunk, and that he had intentiona­lly fired at police.

Garcia was still being held at the county jail Wednesday on a combined bail of $175,000, jail records show.

Aggravated assault against a public servant is a first-degree felony punishable by five to 99 years in prison, and a fine of up to $10,000. Aggravated assault is a second-degree felony punishable by two to 20 years in prison and a fine of up to $10,000.

The incident marked the third police shooting in Austin in less than a month.

On March 7, officers opened fire on a man they said was wielding a pickax in the 4800 block of Tanney Street off Springdale Road in East Austin. The man died from his injuries.

On Feb. 19, police shot and killed Thomas Vincent Alvarez, 23, after he led officers on a chase that ended in the 4900 block of Edge Creek Drive.
