Judge revokes bail set for alleged child rapist

An alleged child rapist’s bail was revoked after authoritie­s say he was scheming to have two of his accusers killed.

Controvers­ial Judge Timothy Q. Feeley ruled that Scott Smith, charged with two counts of aggravated rape of a child, posing a child in a sexual act, providing liquor to a person under age 21, and two counts of possession of child pornograph­y, could be released on $1,000 bail last week.

In court Tuesday, Smith, 38, of Salisbury was waiting to be fitted with a GPS bracelet after posting bail when Assistant Essex District Attorney Michael Sheehan went to Judge Thomas Drechsler with a motion briefly outlining the scheme Smith allegedly hatched from inside the Middleton jail, according to Carrie Kimball-Monahan, spokeswoma­n for Essex District Attorney Jonathan Blodgett.

Feeley had mandated that Smith submit to electronic monitoring and live with his mother in Danvers, where he would be subject to home confinemen­t save for court and medical appointmen­ts, according to court documents.

Prosecutor­s appealed to Drechsler to revoke the bail yesterday, where he ordered Smith to be held without bail until a hearing on Oct. 15.

Details of the alleged murderfor-hire plot were scheduled to be heard yesterday in Salem Superior Court, however all evidence was impounded at the prosecutor’s request. Smith’s attorney, former federal prosecutor Brad Bailey, asked for a delay so he could review the evidence submitted by the commonweal­th.

“I’ve just received materials as recently as late yesterday and this morning and I requested an opportunit­y to review those and have a chance to familiariz­e myself with those before we go forward,” Bailey said. “Obviously, this is an important hearing and we’re looking forward to getting it underway in about 10 days time.”

Bailey declined to comment on the new allegation­s outside of the courtroom, but said his client “maintains his innocence.”

Family members of the two teenage girls Smith allegedly raped were in court. Smith ducked behind his attorney with his head down as Bailey addressed the judge.

Feeley came under fire earlier this year when it came to light he had reduced the bail of a Maine resident, John Daniel Williams, one month before Williams returned home and allegedly shot to death Somerset County Sheriff ’s Cpl. Eugene Cole, 61, to stop the father of four from arresting him.

Williams, 30, was being held on $7,500 bail in the Bay State on weapon charges. He walked out of jail after Feeley reduced the bail to what he said was an “appropriat­e” $5,000.
