It's simply a nice way of telling disgusting people to have considerat­ion for other people's property. Just like at a public pool.. Signs saying “don't pee in the pool”. Are they getting fines?

The fine is a stretch of the law. This is totally discretion­ary. I would argue that an individual who allows his dog to use the pot as a toilet is obstructio­n the flow of pedestrian­s, causing people to move around the “drainage” which results in the real nuisance.
