Notice is hereby given that the following described property will be sold at public auction to the highest bidder in the main lobby of the Custer County Courthouse, Broken Bow, Nebraska on March 8, 2021 at 11:00 a.m.:

The Southwest Quarter (SW¼) of Section Thirteen (13); the South Half of the South Half (S½S¼) and the Northwest Quarter of the Southwest Quarter (NW¼SW¼) of Section Fourteen (14); the East Half of the West Half (E½W½) and the East Half (E½) of Section Twenty-three (23); the West Half of the West Half (W½W½) of Section Twentyfour (24); the West Half of the Northwest Quarter (W½NW¼} of Section Twenty-five (25); and the North Half of the Northeast Quarter (N½NE¼), the Northeast Quarter of the Northwest Quarter (NE¼NW¼), the Southeast Quarter of the Northeast Quarter (SE¼NE¼) and the east 16 acres of the Southwest Quarter of the Northeast Quarter (SW¼NE¼) of Section Twenty-six (26); all in Township Eighteen (18) North, Range Twenty-one (21) West of the 6th P.M., Custer County, Nebraska; and

AND EXCEPT a tract of land located in the Southeast Quarter (SE1/4) of Section Fifteen (15), Township Eighteen (18) North, Range Twenty-one (21) West of the 6th P.M., Custer .County, Nebraska, described as follows:. Referring to the northwest corner of the said Southeast Quarter (SE1/4) of Section Fifteen (15), thence So. 40°30’37”E, (assumed bearing) a distance of 2141.59 feet to the point of beginning, said point being on the easterly existing County Road #998 rightof-way line, thence No. 82°22’17”E a distance of 935.65 feet, thence So. 18°25’14”E, a distance of 1010.27 feet, thence So. 87°05’46”W, a distance of 1052.27 feet to the easterly existing County Road #998 rightof-way line, thence No. 12°25’59” on said right-of-way line, a distance of 908.92 feet to the point of beginning (the “Trust Property”).

The Trust Property will be sold subject to all liens and encumbranc­es of record having priority over that Deed of Trust dated May 10, 2013 in which Custer Federal Savings and Loan Associatio­n is named as Beneficiar­y and Trustee, and filed for record on May 10, 2013 in Book 13 Page 3125 in the records of the Register of Deeds of Custer County, Nebraska. Said Deed of Trust was modified by that Modificati­on of Deed of Trust dated July 13, 2017 in which Custer Federal State Bank is named Beneficiar­y and Trustee, and filed for record on August 1, 2017 in Book 17, Page 5587 in the records of the Register of Deeds of Custer County, Nebraska.

The Trustee’s sale shall be conducted pursuant to such additional or different terms as the Trustee may announce at the time and place of the Trustee’s sale. The highest bidder at the Trustee’s Sale will deposit with the Trustee, on the day and time of the sale, the full amount of the sum bid at the Trustee’s sale, in cash, or certified funds, except when this requiremen­t is waived by the Beneficiar­y. This sale is made without any warranties as to the title to or condition of the property.
