Waheed sentencing postponed on Thursday

The sentencing of Khalil Waheed, convicted in June of leaving the scene of a fatal accident, was postponed.

KINGSTON, N.Y. » The sentencing of Khalil Waheed, convicted in June of leaving the scene of a fatal accident, was postponed on Thursday.

State Supreme Court Judge Richard Mott delayed the sentencing until Aug. 17 to allow for Defense Attorney Eric Naiburg to submit, in writing, a motion to dismiss the case. Mott required Naiburg to submit that motion by noon Monday. Prosecutor­s must answer that motion by noon Wednesday.

Sentencing is now scheduled for Aug. 17 at the Ulster County Courthouse at 10 a.m.

The maximum Waheed could receive is 2-1/3 to seven years in prison.

In early June, Waheed was convicted of leaving the scene of an accident without reporting it in connection with the September 2016 death of Ashlee Crescione. Leaving the scene was the more serious of two felony charges against Waheed. The state Supreme Court jury found Waheed not guilty of criminally negligent homicide.

The maximum sentence for leaving the scene is 2-1/3 to seven years in state prison.

Waheed initially was charged with manslaught­er, for which he could have been imprisoned for up to 15 years if convicted, but a grand jury declined to indict him on that count.

Waheed, 24, of Mountain View Avenue, Kingston, was on trial in connection with a Sept. 20, 2016, incident that claimed the life of Crescione, 23, of Bruyn Avenue, Kingston.

Authoritie­s said at the time that Crescione suffered serious injuries when she was dragged by a vehicle near her Midtown home and then fell to the ground and struck her head. She died three days later at Albany Medical Center.

The defense maintained Waheed did not know Crescione was holding onto his van or had fallen off as he drove off.

Waheed was not arrested until 16 days after the incident.
