Lansdale man faces jail for assaulting female relative
Against his wishes, a Lansdale man learned he must report to jail next week after he was convicted of assaulting a female relative during a disturbance at his Lansdale home.
“I don’t want to go to jail,” Jashim Uddin, with the help of a Bengali interpreter, told Montgomery County Judge Todd D. Eisenberg after the judge sentenced him on Monday to 10 days to 23 months in the county lockup on charges of simple assault and harassment and ordered him to report to the jail on Jan. 16.
“You have no choice,” Eisenberg responded, warning Uddin that if he doesn’t report to jail as ordered he risks being sentenced to even more jail time.
Uddin, 50, of the 200 block of Ridge Street, was convicted by Eisenberg of charges of simple assault and harassment during a non-jury trial last September in connection with a 12:26 a.m. Feb. 23, 2016, incident at the Ridge Street address.
With the charges, prosecutors alleged Uddin, who is a native of Bangladesh, grabbed a female relative by her hair, kicked her and threw her to the ground during a disturbance at the home. Lansdale police were summoned to the home and found Uddin chasing the “hysterical” woman west in the 100 block of East Main Street, according to court papers. The woman complained of chest and stomach pain and was transported to a local hospital by ambulance for evaluation, according to the arrest affidavit filed by Lansdale Police Officer David Gori.
Assistant District Attorney Lindsey O’Brien argued for several months of jail time against Uddin.
“There are serious concerns about history repeating itself,” O’Brien argued.
Defense lawyer Patrick McMenamin argued for a probationary sentence on behalf of Uddin, maintaining Uddin had no prior criminal record and that there was no evidence that he is a danger to others.
While Eisenberg said he didn’t agree with prosecutors that several months in jail was warranted he added, “I do believe you need some time in jail. You are to stay away from the victim in this case.”
In a letter to the judge, the victim wrote that Uddin’s assault has left her with emotional scars that will last a lifetime.
“Every day, memories of the abuse hunt me down,” the woman wrote, claiming she still suffers back pain from the assault.
As the hearing concluded, Uddin uttered that the allegations against him were false.
