Havertown man may get state time for childporn offenses
MEDIA COURTHOUSE » A 71-year-old Havertown man faces two to four years in state prison after pleading guilty Monday to one count of possessing child pornography.
Raymond Giambuzzi, of the first block of Drexel Avenue, was arrested in June and charged with 112 counts of attempted dissemination of child pornography, sexual abuse of children and criminal use of a communications facility, all felonies of the third degree.
Giambuzzi was identified as a Skype user who was uploading images of child pornography in an investigation initiated by Delaware County Detective Edmond Pisani in March. Pisani was able to trace the unique Internet Protocol number of the offending computer to Giambuzzi’s address, where detectives and a Haverford Township K-9 officer executed a search warrant May 10.
During the search, Giambuzzi attempted to hide a flash drive in his pocket that contained child pornography, according to an affidavit of probable cause for his arrest. He told detectives he had been carrying it around in his pocket since that morning for fear that his wife would find it. The flash drive contained more than 700 images and more than 100 videos of child pornography, according to the affidavit.
Investigators also discovered more than 974 images of child pornography and 1,532 images of “child erotica” that might not meet the legal definition of child pornography on a living room desktop computer.
The computer additionally contained Skype chat logs indicating Giambuzzi was spying on and trading pictures of his family members, as well as “a lot (of) sexual conversations about incest,” according to the affidavit.
Giambuzzi, who remains free on 10 percent of $75,000 bail, is scheduled for sentencing Jan. 4 pending an evaluation by the state Sexual Offenders Assessment Board to determine whether he fits the criteria for a sexually violent predator.
The plea agreement worked out by Assistant District Attorney Danielle Gallaher and defense counsel Vincent Difabio also calls for Giambuzzi to register as a sex offender for 15 years under Megan’s Law, as well as six years of consecutive sex offender probation, forfeiture of the electronics used to commit the crimes and enrollment in a sex offender program.
