A Chester man was sentenced to 5-10 years in a state prison after pleading guilty to person not a possess a firearm in a July 2023 shooting and vehicle theft case.

Tyrone Womack, 33, of the 1300 block of West Seventh Street, has been in custody since the July 7 altercation that allegedly began with Womack inside the victim’s residence.

Additional charges including aggravated assault, robbery of a motor vehicle, theft and criminal trespass were dismissed under the negotiated plea worked out by Assistant District Attorney Lewis Reagan and defense counsel Kevin O’Neill.

According to an affidavit of probable cause for Womack’s arrest written by Chester Detective Brian Pot and Delaware County Detective Michael Jay:

Police were dispatched to the 400 block of Jeffrey Street about 9:38 a.m. for a report of a shooting and found a victim suffering from a gunshot wound to the upper right thigh. The victim was transported to Crozer-Chester Medical Center for treatment.

Investigators learned that the shooting had actually taken place about a block away on the 2100 block of Sixth Street. The victim had driven to that location and saw Womack inside their residence without permission. Womack jumped out of a window with a firearm in his hand ran toward the car.

The victim got out and ran from Womack, who fired at the fleeing victim before jumping in the victim’s vehicle and driving off. Police recovered two 9 mm fired casings from the scene.

The victim’s car was later found parked near Womack’s address. He was taken into custody by police and a 9 mm firearm was seized.

O’Neill noted Friday that the plea agreement is in the mitigated range and that he believes it is the appropriate sentence for his client.

Common Pleas Court Judge George Pagano said Womack would be credited with time served to Friday’s date, but he is not eligible for early release. Womack was also ordered to pay costs and provide a DNA sample to state police.
