A 15-yearold CLEARCREEK TWP. — Montgomery County boy has been charged in a fatal crash in May outside Springboro.

Hosny Mousa, of Washington Twp., Montgomery County, is charged with aggravated vehicular homicide, vehicular homicide, no operator’s license and speeding.

Earlier this week, Judge Joe Kirby ordered Mousa to remain in Warren County juvenile detention until Nov. 2.

He was charged and held after his arraignment on Sept. 13, more than three months after the May 25 crash in which Noah Theiss, 17, of Franklin Twp., was killed on a narrow, winding section of Springboro Road.

The charges were filed once the Ohio Highway Patrol submitted the accident reconstruction report, Warren County Prosecutor David Fornshell said Friday.

Theiss lived in Franklin Twp. and attended Bishop Fenwick High School.

Three homemade wooden crosses and flowers mark a roadside memorial on the south side of the road, just east of the Sycamore Preserve Park southeast of Springboro.

“He was a fun-loving friend to all; he loved his family and friends dearly and honored all

relationships,” according to his obituary.

“Noah, Rest Easy,” reads a plaque hanging from one cross. “RIP Forever,” reads another. The third notes the crash date.

Theiss was pronounced dead at the scene, just east of where Red Lion-Lytle Road runs into Springboro Road and heads north toward Springboro.

He died after being partially ejected in one of a series of tragic fatal crashes in the area involving teen victims, according to reports.

He was a passenger, not wearing a seatbelt, in his parents’ 2013 Honda allegedly driven by the 15-year-old when it crashed about 8:10 p.m., on Springboro Road near Red Lion-Five Points Road, in Clearcreek Twp., Warren County, according to the Ohio Highway Patrol.

“He was so young. I don’t think he should have died

this way,” Gabe Hoel, a friend of the victim, said after the crash.

Mousa was cited for driving at 67 mph in 55 mph zone. However a trooper indicated a sign 0.2 mile from the crash warns of sharp turns and suggests drivers slow to 25 mph.

Investigation determined the car was eastbound on Springboro Road when it

went off the right side of the roadway, striking a utility pole and rolling over several times.

Theiss, the right front passenger, was partially ejected through a sun roof in the car.

A rear passenger was treated and released from Atrium Medical Center.

Mousa was treated and released from Dayton Children’s Hospital South Campus in Springboro.

The crash occurred in a rural area, just southeast of Springboro.

Lawyer Joshua Burns was appointed to represent Mousa.
