2 indicted, 1 charged in Tipp City home invasion, assault

Two men accused of TROY — breaking into a Tipp City residence Nov. 26 and assaulting and restrainin­g a resident with duct tape before stealing guns and a vehicle have been indicted on multiple felony charges by a Miami County grand jury.

A Dayton woman also has been arrested by Tipp City police and accused of complicity in the alleged crimes.

Carl E. Davis, 55, and Shay Wooley, 49, whose addresses are listed on court documents as North Hyatt Street, Tipp City, were indicted on one count of kidnapping, one count of grand theft of a motor vehicle, six counts of grand theft of a firearm, two counts of aggravated burglary, a gun specificat­ion and one count of felonious assault.

They are being held in the county jail on $330,000 bail each set following their arrests in Dayton on Nov. 26. An arraignmen­t date for Davis and Wooley was not yet available.

Tipp City police reports said the home’s occupant reported he was alone when two men entered the residence. He said he was hit in the head before being restrained by the men using duct tape on his arms and legs.

Police arrived around 6 p.m. to find the man free but tape hanging from his wrist.

He said intruders stole guns from a gun safe and left with one of his vehicles.

The vehicle was located that evening by Dayton police on Main Street with three people inside. They were brought back to Tipp City for questionin­g before Davis and Wooley were charged and jailed, according to police.

The resident was taken to Grandview hospital for a medical check.

After additional investigat­ion, police charged Kimberly Fannin, 34, of Dayton with complicity to kidnapping, complicity to aggravated burglary, complicity to aggravated robbery and two charges of complicity to theft. She is accused of knowing about the robbery plans. Bail for Fannin was set Monday in county Municipal Court at $29,500.
