Judge denies ex-Miamisburg teacher’s request
Woman accused of sex with teen wants grand jury testimony in trial.
The request by a former Miamisburg teacher indicted on charges of sexual battery and unlawful sexual conduct with a minor student to have all grand jury testimony prepared for trial has been rejected.
But the judge’s ruling in the case against Jessica Langford, 32, of Centerville, left open the possibility that grand jury testimony of certain witnesses may be available for trial, which is set for April.
The attorney for the former Miamisburg Middle School teacher requested the secret proceedings be available for trial because their absence may “deprive the defendant of a fair adjudication of the allegations,” Montgomery County Common Pleas Court records state.
Attorney Lawrence Greger said there may be a “particularized need” in the case that would allow Judge Timothy O’Connell to permit the request, court records show.
O’Connell’s ruling states “the parties conclude that the existence of a particularized need
is not evident at this time.”
“The evidence, at this point, seems to indicate that a particularized need may develop at trial, as this matter seems to turn on the existence of possible inconsistent statements by two witnesses,” McConnell’s ruling filed Jan. 11 states.
“At this time, the debate is whether the court should order a transcript prepared of the grand jury testimony of the two witnesses involved in anticipation that a particularized need would develop,” O’Connell’s ruling states.
Langford was indicted Nov. 14 on three counts of sexual battery and three counts of unlawful sexual conduct with a minor. On Nov. 21, Langford pleaded not guilty to all counts and has remained free on conditional recognizance, court records show.
Langford is accused of having oral sex and intercourse with the alleged victim, according to court records filed in December.
Those court records state Langford is accused of performing oral sex on and receiving oral sex from a teenage Miamisburg Middle School student in late May.
Langford is also accused of having intercourse with the teen, according to the documents filed by the Montgomery County Prosecutor’s Office.
The document was a response to Langford’s request that prosecutors name her accuser and provide specific allegations she faces.
The prosecutor’s office identifies the alleged victim only by initials.
Langford resigned from Miamisburg schools May 24, shortly after being informed of the allegations, according to school district records.
She was hired as a student teacher in the Miamisburg district in 2006 and served in a similar capacity in Dayton Public Schools, records show.
Miamisburg City Schools records requested by this news outlet in the spring show the woman had a solid tenure in the district. She was hired full time in August 2008, serving nearly nine years at three schools while receiving good evaluations, records show.
