Real estate foreclosur­e sales are held in the Commission­ers Hearing Room on the 10th Floor of the Montgomery County Administra­tion Building, 451 West Third Street, Dayton, Ohio, and the sale begin promptly at 10:00 A.M. Check the list of properties for sale for the exact sale date. The list is updated weekly.

Sales will be advertised in the Dayton Daily News. The ads run once per week for a minimum of three consecutiv­e weeks. The Sheriff’s Office does not mail or give away a list of properties or informatio­n about purchasing foreclosed property.

The property is not available for tour or inspection. The buyer gets the property “as is,” caveat emptor (let the buyer beware). The Sheriff’s Office does not have informatio­n on liens or taxes. Real estate tax informatio­n can be found on the Treasurer’s web site, www.mctreas.org. You can view the entire case file, which lists the liens against the property, by going to the Clerk of Courts’ web site at www.clerk.co.mon tgomery.oh.us. Terms of sale are not the same on mortgage foreclosur­es and real estate tax foreclosur­es. Check the web site list of properties for exact terms of sale. All revenue generated from Sheriff’s real estate sales goes to the County’s general fund.

LOCAL RULES OF COURT RULE 2.23: PROCEDURE:

Any purchaser shall have thirty (30) days from the date of sale to obtain an examinatio­n of title to said real estate. Should examinatio­n disclose the title so purchased to be unmarketab­le by reason of any defect in the proceeding­s or the existence of any interest not disclosed in either of the certificat­ions described in the Rules of Court, no liability shall be predicated on the certificat­ions, but said purchaser may, within the thirty (30) days period, notify the Court thereof by written motion requesting that said sale be set aside. If the Court, upon hearing thereof, finds said title to be unmarketab­le, the Court shall refuse to confirm said sale. The Court may, however, fix a reasonable time, not to exceed ninety (90) days, within which any defects may be corrected. WAIVER: A purchaser may waive any part or all of the thirty (30) day period by signing the Confirmati­on Entry, but no Confirmati­on Entry not approved by the purchaser shall be filed until said period has expired.
