Terms of Sale
TERMS OF SALE ARE AS FOLLOWS UNLESS OTHERWISE STATED IN AD:
MORTGAGE SALES: The successful bidder must deposit $2,000 if the appraisal value is less than or equal to $10,000; $5,000 if appraisal value is greater than $10,000 but less than or equal to $200,000; $10,000 if appraisal value is greater than $200,000 immediately following the sale. We will accept cash, certified check or a personal check with proper ID and signed in our presence for the deposit. The personal check must be drawn off of a local bank. If you wish to put the property in a person’s name not attending the sale you must have power of attorney to do so. The required deposit is waived where the purchaser is the first lienholder. The unpaid balance of the purchase price must be paid to the Montgomery County Sheriff by certified or cashier’s check within thirty (30) days of the filing of the confirmation entry. The plaintiff’s attorney will prepare the confirmation entry and the deed. The Montgomery County Sheriff’s Office will transfer and record all deeds within 14 days of receiving the deed, confirmation entry and final payment. The purchaser may be responsible for paying the transfer, recording and conveyance fees for cases purchased at the Sheriff Sale.
TREASURER’S TAX LIEN SALES: The successful bidder must deposit $1,000.00 PLUS TRANSFER AND RECORDING FEES immediately following the sale. We will accept cash, certified check or a personal check with proper ID and signed in our presence for the deposit. The personal check must be drawn off of a local bank. The unpaid balance must be paid to the Montgomery County Sheriff by certified or cashier’s check within thirty (30) days from the date the confirmation of sale is filed by the plaintiff’s attorney. All deeds will be prepared by the attorney of record and recorded by the Montgomery County Sheriff’s Office within 14 days of receiving final payment from the purchaser. COURT ORDER: By order of the Montgomery County Common Pleas Court, the minimum raise permitted during bidding is $100.00.
