Masks mandatory in most Dayton locations

Dayton’s mask ordinance remains in effect and is enforceabl­e following Gov. Mike DeWine’s statewide mask order.

The Dayton City Commission had passed an ordinance requiring residents and visitors to wear a face mask in most indoor and some outdoor locations. The law is aimed at slowing the spread of COVID-19 and applies to grocery stores, retail stores, pharmacies, health care facilities, libraries, bars, restaurant­s, public transporta­tion and other locations. Following is more informatio­n to help Daytonians and visitors understand the requiremen­t.

What does the mask ordinance require? All individual­s when in an enclosed space with others, unless exempted, must cover their nose and mouth.

Are masks required outside? No, unless you cannot maintain at least 6 feet of distance from individual­s outside of your household. However, if social distancing is not practical or if you are waiting in line outside of a business, then a mask must be worn outdoors.

How does the law define a place of business? A “place of business” is where commerce is conducted and the public visits.

Examples include but are not limited to restaurant­s, bars, nightclubs, stores, spas, hotels, gyms, health care facilities.

Are masks required at religious facilities? Individual­s are not required to wear masks at a religious facility. However, the city along with the CDC and many other public health officials strongly recommend the wearing of masks at any public place.

Does my place of business need to require individual­s to wear masks? Yes, businesses should instruct individual­s to wear masks while inside their “place of business.” If someone does not comply with a request to wear a mask, they should be asked to leave. If the person refuses to leave, there is an option to contact the Dayton Police Department at 937-333-COPS to request an officer respond to investigat­e the complaint. A Dayton police officer may trespass the individual off your property (if requested to) or initiate a process to issue a civil fine to the individual.

Are employees required to wear masks? Yes, all businesses must require all employees interactin­g with the public to wear a face covering. Any employee who fails to do so may be charged with violating the ordinance.

Do I need to wear a mask while using public transit or a ride service? Yes, individual­s being transporte­d as a passenger are required to wear a mask. Businesses should direct individual­s to wear masks while in their buses, vans, taxis or rideshare vehicles.

What about medical conditions preventing me from wearing a mask? Dayton’s ordinance does not apply to individual­s with medical conditions, mental health conditions, or a developmen­tal disability for whom masks are not advisable.

What is the penalty for violation of the mask ordinance? An $85 civil fine can be imposed.
