Dayton man, 29, sentenced to 36 years in state prison

A Dayton, Ohio, man, Nicholas R Mingus, 29, was sentenced by Judge Chad Kukelhan of Adams Circuit Court to serve 36 years with the Indiana Department of Correction­s for serious bodily injury crimes in committed early in 2022.

Adams County Law Enforcemen­t and Detention Center records state Mingus had been in custody there since February of 2022 but his case finally came to a close on August 18 of this year when he pled guilty to a deal worked out by his attorney Gregory W. Ridenour and Adams County Prosecutin­g Attorney Jeremy W. Brown.

Mingus pled guilty to a level three felony charge of attempted aggravated battery and being a habitual offender. The sentence this week calls for Mingus to serve 16 years on the battery charge but as Kukelhan wrote “the Court further enhances said sentence by an additional 20 years for a total of 36 years (due to be a habitual offender). Said sentence shall be served in the Indiana Department of Correction.”

Kukelhan did grant Mingus full credit time for 560 actual days served in custody for the offense but the court assessed court costs of $189 as a judgment against the defendant.

Per the plea agreement worked out by the attorneys, the court dismissed a level five felony charge for theft, a level six felony charge for resisting law enforcemen­t and Ridenour was discharged from any further duties as pauper counsel in the matter. The original charges against Mingus were listed as aggravated battery use when the assault causes serious permanent disfigurem­ent, theft, and

resisting law enforcemen­t when the defendant used a vehicle as a means of resisting. Final sentencing of Mingus came after the court had considered the presentenc­e investigat­ion report filed with them by the Adams County Probation Department.
