A 27-year-old man was shot in the back while trying to break up a fight between his brother and his mother's boyfriend at their Hercules home Friday morning, police said.

Officers went to the home in the 200 block of Brighton Street around 9:20 a.m. for a report of a possible shooting, the Hercules Police Department said in a statement. They called for the occupants to come outside but received no response.

A woman then arrived at the home and said her three adult sons and boyfriend were inside, police said. She called one of them and three men exited the residence.

Officers detained the men and found a 27-yearold man inside the home with a gunshot wound to his lower back, police said. A handgun and a bullet casing were also recovered.

The wounded man was taken to an area hospital, where he was listed in stable condition.

An investigation revealed the woman's 31-year-old son got into an argument with her 39-year-old boyfriend, police said. The boyfriend reportedly drew a stun gun and fired it at the son but missed. A handgun then “appeared,” police said, and the men began fighting for it.

The 27-year-old son tried to break up the fight and was shot in the back, police said. The handgun then fell to the floor. The 31-year-old son reportedly picked up the weapon, hit the boyfriend on the top of the head with it and called for an ambulance.

The 31-year-old son was arrested and booked into the Martinez Detention Facility on charges of assault with a deadly semiautomatic weapon, assault with a deadly weapon, possession of an unregistered handgun and possession of a firearm while the subject of a criminal protective order. The order did not apply to anyone at the home.

After receiving treatment for a cut to his head, the boyfriend was arrested and booked on charges of assault with a deadly weapon and felon in possession of a stun gun.
