Man charged in Rodeo rapes sues because of alleged injuries

RICHMOND >> A Rodeo man accused of raping two women in separate incidents has filed a lawsuit demanding $16 million in damages, alleging that he suffered damage to his wrists when deputies cuffed him too tightly in his July 2022 arrest.

Samuel Oxley, 50, filed the handwritte­n lawsuit last month. It was formally assigned to a federal magistrate on Monday, court records show.

The suit alleges that Oxley suffered damage to his wrists that will require surgery — and left him with carpal-tunnel and nerve damage — when a deputy handcuffed him too tightly on July 7, 2022. Oxley wrote that he complained several times of intense pain when he was being arrested and taken to detectives for an interview, but that his requests were ignored. He said he requested a doctor but didn't see one for two months.

“I'm still having problems with my wrists and numbness in both hands and taking pain pills for the pain,” Oxley wrote.

Oxley was arrested last year and charged with two counts of forcible rape, two counts of forced sodomy and two counts of forcible oral copulation. Authoritie­s

allege that he raped a woman in August 2021 after picking her up while she walked on a Richmond sidewalk. In July 2022, the same day of his arrest, Oxley allegedly sexually assaulted a second woman after giving her a ride from San Pablo to Rodeo.

As exhibits to the suit, Oxley included documentat­ion of “moderate bilateral carpool (sic) tunnel syndrome” he received last September. He also included copies of a police report where deputies note they added a second set of handcuffs after Oxley — who noted he weighs approximat­ely 320 pounds — complained of pain.

The police report also says that Oxley denied possession of a methamphet­amine pipe allegedly found in his pocket, and spontaneou­sly referred to one accuser as a “crackhead” while police were conducting a sexual assault evidence collection procedure on him.

In his criminal case, Oxley was ordered to stand trial after a preliminar­y hearing last December. He was last due in court Monday, for appointmen­t of a new attorney, after his old lawyer bailed from the case in late January. His next court date has been set for March 27, and he remains in custody on a whopping $18.64 million bail.
