Bill would create ‘indecent assault’ charge
The proposed legislation would create the criminal offense of indecent assault, which applies to any touching of the breast, buttocks or genitals done without consent and with the intent to sexually arouse or gratify the offender.
Current law
Groping is considered a Class C misdemeanor, the lowest level of criminal offense in Texas, and is punishable by a fine of up to $500.
If legislation passes
Groping would be elevated to a Class A misdemeanor, with a maximum penalty of a year in jail and a $4,000 fine.
